Mamu memang dari dulu tak percaya dgn Mangkuk Hayun Salehuddin ni, entah - entah dia ni lah manusia yg sabotaj PR Perak, sampai boleh jadi rampasa kuasa disana. Dia ni berhasrat untuk bertanding di Behrang selepas salah seorang katak di Perak ditangkap MACC, tapi entah mcm mana boleh tak berjaya. Itu pasal mamu kata dia ni ada peranan dlm kes di Perak. Tak payah bertanding, lepas rosakkan PKR.............

Abdul Rahman Lim: Bravo to you, Salehuddin Hashim. RM9,000 is for you a 'pittance' for the job of PKR secretary-general, yet you have the cheek to offer your services for RM1 as chief executive officer of Kumpulan Perangsang Selangor Bhd.You are talking rubbish. Maybe RM1 is nothing, but there are bigger things behind the CEO position from which you can reap millions. You think we are all small kids with no brains?
BTN: It's time we tell all politician that they as wakil rakyat (elected representatives) exist to serve the people, not to get rich. The Pakatan Rakyat culture is that of service to the people. If they want to make money, they should join BN, and Umno, in particular.
Rayfire: RM9,000 is not pittance. US$3,000 is worth even more! This just confirms that these so-called 'original activists' are just disgruntled Umno members who, despite leaving PKR, still expect personal gains.The slogan for Umno 'Dulu, kini dan selama-lamanya' ('Umno was here then, it is here now, and will be here forever') should be changed to 'Dulu berprinsip, kini korup, dan selama-lamanya angkuh!'('Umno was principled then, it is now corrupt, and will forever be arrogant').
Tanteo: It's sad that Anwar Ibrahim surrounds himself with people like this, not to mention all the other frogs. You can take them out of Umno, but you cannot take the Umno out of them. Sometimes I have my doubts about Anwar. I'd trust Syed Husin Ali any day.
Wira: It's the same old story whenever a PKR leader resigns. Why can't a leader land himself a job in the commercial sector on his/her own merits without pulling strings or depending on political patronage? We have such low quality materials in our political leadership. It's no wonder this country is going to the dogs.
Tired: All these revelations about former PKR members wanting this and that (tenders, GLC posts, chairmanship, etc) is proof that when you are in power, PKR, DAP or PAS, you become the same as Umno, MCA and MIC.Welcome to Malaysian politics, the politics of patronage. So all those promises about wiping out corruption, 'berjuang untuk rakyat', (fighting for the people), fighting for justice and equality, they are just political statements.Don't believe politicians, no matter which party they represent. Ong Guan Sin: I commend the openness and seriousness on the part of Anwar in discussing the succession issue. Succession planning is an important aspect of a serious organisation, but a really tricky one for a organisation full of politicians.Anwar tackled the question well, by leaving it to its core business - the democratic process. I am sure this has pushed the maturity of democracy in Malaysia another notch higher. For those who have been alleging Anwar to be 'mad' about prime ministership, this succession discussion has proven them wrong.

DAP has made it clear that even if it should have the majority of seats in Parliament, it will not be want the position of opposition leader and would continue to support PKR and Anwar.BN is hoping to cause chaos within Pakatan through the subservient mainstream media, but it will fail miserably. The people are not fools. As for the 'independents' their future is doomed for their double-crossing.

Ghkok: I am thrilled. Under the most severe test since March 2008, I see a Pakatan Rakyat that is standing firm, standing tall and united. Petricio: All these frogs fool themselves, thinking that it is on their own merit that they were elected into Parliment. By defecting they have effectively put the final nails into the coffins of their career.The mainstream media are highlighting this as if Pakatan were falling apart. But I believe many people are seeing the positive ways in which the Pakatan states are run. Perhaps Penang stands out as an outstanding one.

PENANG ABOUT TO GET 700M IN INVESTMENT

PENANG, June 17 —
Penang is set to receive about RM700 million in investments from two companies this week, says InvestPenang's executive committee chairman Datuk Lee Kah Choon.

Lee said the state government would be finalising the deals with the companies which would then be followed by the signing of agreements to purchase the land for their plants.

"We need to finalise a few issues first before signing the agreements with the companies which will be based in the mainland," he told a media briefing today.

He said the first company was based in US and the other was a multinational corporation.
"We expect the two companies to create 200 high-end jobs," he said.

Earlier, he said, the state has so far received RM396 million in foreign investments.
St Jude Medical, which produces cardiac rhythm management products, announced in January to invest RM108 million and Chakra Biotech, which is involved in the screening of new drugs, announced in February to invest RM8 million, he said.

Lee said National Instruments, which produces software and hardware instrumentation, would invest RM280 million.

"Their investments will create about 2,000 jobs when they start their operations," he said.
Meanwhile, Lee said the state's Career Assistance and Training (CAT) Centre has set up special training programme for students from hardcore poor families.

"The programme will give priority to applicants from hardcore poor families. We are offering 100 posts for 2000-2008 school leavers and job-seekers who had registered with the CAT Centre," he said.

He said centre would also offer successful applicants a special allowance of RM800 a month during the training period. — Bernama

MARCH 3 – During the 1970s, Penang’s industrial sector helped transform the state’s economy, providing in the process a blueprint for Malaysia’s rapid industrialisation. Since then, industry and Penang have been intricately linked.

When the new state government took charge two years ago, observers expressed concern that politics and fragile federal-state relations would have an adverse effect on Penang’s ability to continue to attract investments.

In an interview with Penang Economic Monthly, Invest Penang’s executive committee chairman, Datuk Lee Kah Choon (pic), elaborates on the organisation’s growing role and how it now offers existing and potential investors value-added services.

Can you give us a brief overview of Invest Penang?
The main reason Invest Penang was set up was for industrial promotion. The Industrial Division of the Penang Development Corporation (PDC) used to be responsible for this. In 2004 PDC decided that it would not continue with that function anymore, and this led to the birth of Invest Penang.

Penang has a large industrial sector; therefore industrial promotion is a must. Someone has to do it! Industrial promotion requires a lot of financial support and Invest Penang is a cost-driven centre in the sense that our main objective is to attract people to come in, to invest in Penang so that the state will benefit.

Invest Penang is a not-for-profit entity of the state government. This is why funding for the organisation is so important. We cannot stop our work just because funding doesn’t come in. We need to run our administration. We also have to run our promotions arm which incurs relatively expensive costs; we have to bring investors out here to provide them valuable market exposure and encourage potential investors to invest in Penang.

Rain or shine, we have to do this. But of course we are working very hard to do more with less.We have cut down a lot on our expenditure, for example our travel expenses. We all travel on economy class flights now, rather than first or business class. That alone has made a huge difference, and instead of one trip we can now make two! In terms of accommodation we have also made some adjustments, and stay in three-star hotels; all we really need is a clean, safe place to stay. Luxury is not a consideration. Aside from internal cost-cutting measures we are also working on more collaboration with our international counterparts. For instance when we were promoting Penang in Hong Kong we worked with the Hong Kong Trade Office. We also work with private organisations like MNCs in Penang that have factories or offices worldwide, to see what we can do with them and for them.

In the last couple of years our scope has expanded significantly into the services sector. Why?
When we examined the economic structure of the state we saw that the ratio of services to manufacturing was 60:40. It is very important for Invest Penang to move into promoting the services sector and not just confine ourselves to industrial promotion. The Chief Minister is the chairman of Invest Penang and he drives us and gives us direction. The state has also set up two advisory panels – the Penang Industry Advisory Panel and the Penang Services Advisory Panel – which provide us feedback on how to move the Penang economy.

When you joined Invest Penang two years ago, what did you feel was the biggest challenge?
Internally, we had to get our direction right and at that time I felt we had to“flatten” the organisational structure. Before I joined there was a CEO, a COO and for a small organisation with about 20 staff members this was not ideal. So we revamped the structure and created a new general manager’s post, which helped to stretch our budget.

The next challenge was to expand the scope of our reference from industrial promotion to include the services sector without escalating our expenditure. In other words we now have to do a lot of multi-tasking!

Then there was also the challenge of maintaining the investment flow into Penang, especially with the change of state government. My feeling is that the change of state government wasn’t such a big deal to the investment community in Penang; most of these people don’t want to get involved in local politics as they are all business people first and foremost. I did feel that they were very positive about the change, in the sense that it was driven by the people.

In terms of strategy was there a dramatic change when you took over Invest Penang?
No. I don’t believe in overhauling systems and doing things 180 degrees differently. After all, I believe in continuity. We wanted to carry on with business “as usual” but to do things more efficiently. The biggest change was really to widen our scope of business to include the services sector.

We are also in the midst of setting up various centres to assist Penang’s industry. I have mentioned the two advisory panels. Due to the 2009 financial crisis we were concerned about rising unemployment so we set up a Career Assistance and Training (CAT) Centre, where we work hand in hand with other agencies including the Penang Skills Development Centre (PSDC).
We’re very conscious that Invest Penang shouldn’t duplicate the role of other state agencies, so as far as training is concerned we leave that to PSDC. What we do is provide a jobmatching service at the CAT Centre. The state government has allocated a budget of RM10mil to provide assistance to the unemployed as well as school-leavers. The rationale behind this is, if we don’t take care of school-leavers they could end up unemployed. We have come up with attachment programmes that are run by PSDC to give them practical hands-on training in the hope that they will be able to enter or reenter the workforce after their attachment.

We have also set up Penang Investment and Tourism offices; we have a centre at the Kuala Lumpur International Airport to publicise Penang to local and international travellers. We also have a representative in Singapore who assists us in reaching out to potential Singaporean investors.

Aside from these developments, is there any Invest Penang initiative you’re very optimistic about?
Yes, our new Small and Medium Enterprises Market Advisory Resource & Training (SMART) Centre is an important initiative for Penang. Invest Penang feels that the smes play a crucial role in the local economy. Although the 27,000 or so Penang-based SMEs are the backbone of the economy, many of them have yet to fully realise their potential and become global players in their own right.

The environment that the SMEs operate in is highly competitive; they simply can’t pay the sort of salaries that MNCs can afford and they also lack funds for R&D activities. Although the federal government has tried to do something for the smes through financial grants and has even set up an SME bank, the feedback I receive is that these initiatives are not working as there are problems concerning lack of information, implementation and red tape.

In response to this, the state government through Invest Penang set up the SMART Centre. It’s a relatively new venture and we’ve only recently signed a tenancy agreement for it. At the centre,

SMEs will be able to access data on market intelligence, business advisory information and training services. Its focus will be research on the supply chain because we feel there is a very big gap in terms of the knowledge of what we have and what we can do in Penang.

MNCs may not be aware of what we can do locally, and the SMEs do not know what the MNCs require to a certain extent. So far, when companies actively seek out information about one another in Penang, it’s through word of mouth. We want to create an open, transparent platform so that anybody who is interested in investing in Penang can do their background research at the SMART Centre.

It will offer its services free of charge so membership is not an issue. Of course we would like to involve as many stakeholders as possible in order to publicise the centre and to ensure that knowledge and experience are shared. Research is an important part of the centre because every industry has its own supply chain. We want to investigate each industry’s manpower needs, the existing supply chains as well as the supply chains that we don’t have. This is a large undertaking and we don’t just want to focus on industry, we also want to examine the supply chain of the service industry as well.

What’s your evaluation of Invest Penang’s performance over the last two years?
I don’t know whether I’m the right person to speak on that (laughs). Invest Penang is a forward-looking, active organisation constantly looking to attract new investments, to assist existing investors and also to take the initiative to “plug the gaps” with our new centres. We are taking on greater responsibility and I feel that we are making Invest Penang more and more relevant to the investment community in Penang.

For 2008, industrial investment in Penang surpassed the RM10bil mark according to mida statistics. For 2009, Penang will just break the RM2bil mark, but this figure is for industrial investment only and does not include the services sector. In 2009 a number of hotels opened in Penang, among them Hard Rock Hotel, Eastin and Tune Hotels which are not captured in the investment figures. Similarly the expansion of the Loh Guan Lye Specialists Centre and Suntech Building, among others, will boost the local economy. But all these are not included in the 2009 figure.

What challenges does Penang face in terms of attracting investment?
I feel that the challenges faced by Penang are actually those the nation faces as a whole. When we talk to potential investors we’re not just thinking about how to attract them to Penang and that’s it, our job is done. It’s not like that! Most investors will have a long-term plan for the next five, 10, 15, 20 years. They want to grow and they want to have a clearly defined road map to achieve this growth.

Take Intel, for instance; they came to Penang in 1972 and have been here for 38 years! When we look at these long-term players, we have to understand that we also need to have a long-term plan for them. Invest Penang’s challenges go beyond state boundaries, as there are many factors beyond the control of the state government. I would say that the bulk of issues is not within the state government’s jurisdiction – the two areas where the state government has reasonable influence are confined to land and religious matters. I would say that the main challenges are (in no particular order) security, education, and the ease of doing business, which is closely linked to corruption.

These are the three issues that I think are beyond Invest Penang; if Malaysia doesn’t do well in these three areas this will pull down Penang. As far as education is concerned are we producing enough quality graduates in enough quantity? Can we provide investors with a well educated, highly skilled workforce?

Let’s look at security; a lot of the products and components manufactured in Penang have values greater than gold, so good security is essential. Imagine if a container of chips got lost after leaving the manufacturing plant in Penang – the monetary value of the consignment is one thing, but the damage to Penang’s reputation is another. Most organisations employ just-in- time (JIT) manufacturing so if we lost something in Penang, we would hold up production somewhere else in the world!

Corruption is, of course, a big issue because it adds to the costs of doing business. Investors want the entire process of investment to be as transparent and straightforward as possible so they know the real costs upfront. Hidden costs such as corruption make any planning or projections difficult.

Is there a conflict between state and federal machinery vis-à-vis attracting investment to Penang?
Perhaps that might come into play on the political side of things, but as far as I’m aware we are all working towards the same goal – the financial well-being of the people of Penang and Malaysia as a whole. Both are intertwined after all; if Penang does well then of course Malaysia will benefit.

For Malaysia to progress a lot of changes need to be made irrespective of which party is in charge. Especially in the three areas I highlighted that are related directly to investment. I feel that something is very wrong with the national political climate, otherwise the country wouldn’t be in the state it is now. As we move up the value chain and become more globalised we have to move to a more transparent platform rather than continue doing things that are far from international norms.

Look at the education system – we’re flip-flopping here and there. Even the name of the national language is still referred to as Bahasa Melayu and not Bahasa Malaysia, which is very political. We need to think things through carefully before any announcements are made and we must not allow politics to trap our mindsets. Shifting our mindsets is more important and long-lasting than merely changing parties or governments.

But to go back to the question, Invest Penang works with many local and federal government agencies including the Malaysian Industrial Development Authority, the Multimedia Development

Corporation, the Malaysian External Trade Development Corporation and the PDC. When working with potential investors it’s important to value-add for their benefit which is why we need to work closely with all these agencies. We coordinate the various stakeholders to conclude the deal for the benefit of Penang!

Does competition from other established and emerging South-East Asian economies worry you?
I’m a very globalised person; I don’t see competitors all around! I see other countries and regions as complementary It’s very simple, Penang doesn’t compete with Singapore or even Kuala Lumpur because these are first-tier cities and we’re unable to do a lot of the things that they can. In effect it’s like comparing apples and oranges.

However Penang is a hub for the northern region of Malaysia, southern Thailand and northern Sumatra and we complement each other in terms of business. I’ve always believed that when Penang advances, the surrounding areas also advance and grow. In a regional context, when Singapore grows, Penang can also benefit thanks to the spillover effect. Once Singapore’s new integrated resorts open, we have to think about how we can tap into this and divert some of the tourism traffic to Penang. This isn’t something that Invest Penang will be directly involved with, as we don’t want to create an overlap with the state’s tourism agencies. However, we’ll be more than willing to play a supporting role when the time comes!

What are your thoughts on Penang’s future?
I’m very excited about Penang’s future prospects but I’m also concerned about where the country is going. I sometimes feel that Penang and Malaysia are not moving at the same pace; we have all the potential and all the ingredients for success, but at the federal level, Penang is not being fully promoted. I don’t think that the federal government is getting the most out of Penang yet.

We have a human resource problem in the sense that many Malaysians feel that there are more opportunities overseas for them than within the country. This makes it increasingly difficult to move up the value chain. If we continue to let this brain drain happen we are not going to get anywhere. We need to give top executives and professionals a reason to stay. It’s hard to retain the most able workers and to encourage them to stay in the state and the country. We need to take active action to bring these people back home, to make it easier for them to return. This is the reality. Companies and nations cannot grow unless they can retain able workers.

Despite these challenges you remain optimistic about Penang’s strengths to attract investment …
I am a very realistic person and I can appreciate that there will always be challenges ahead. That’s life. Yet, Penang has tremendous advantages in place, we have a highly trained and skilled workforce which has been built up over a considerable period of time. Of course if we could attract more Penangites home that would be better!

The state is also very internationalised, thanks to its rich trading history, and it has a mature supply chain. The cost of doing business in Penang is still very competitive and we offer locals and expats alike excellent quality of life with a low cost of living. When you take all these factors into consideration, it’s hard not to be optimistic about Penang!

This reform, considered “urgent” by the government, is meant to enhance communication between the various sectors within the PDC and between the PDC and state and external agencies; develop employee capacity and optimize the use of existing resources.

TEORI RAHMAN DAH BERAKHIR. SIAPA PM SELEPAS NAJIB?

Sekadar teori, kalau kenyataan baguih, jika tidak, biaq kita syok sendiri cukuplah....

Ramai pemerhati politik di Malaysia sebelum ini sukar mempercayai berhubung dengan satu teori, iaitu teori RAHMAN yang dikaitkan dengan siapa akan menjadi Perdana Menteri Malaysia dan pemimpin utama politik Negara selepas merdeka. Untuk rekod, teori ini dikatakan bermula selepas Tunku Abdul Rahman mewakili ‘R’ menjadi Perdana Menteri yang pertama dan kemudiannya Tun Abdul Razak mewakili ‘A’ pula dipilih menjadi Pedana Menteri Kedua. Seterusnya digantikan dengan huruf ‘H’ oleh Tun Hussein Onn walaupun Tun Dr. Ismail pernah menjadi Timbalan Perdana Menteri kepada Tun Razak tetapi meninggal dunia lebih awal.

Semasa Tun Hussein menjadi Perdana Menteri, beberapa nama selain huruf ‘M’ Tun Dr. Mahathir disebut-sebut layak menjadi timbalan atau pengganti kepada Hussein seperti Tan Sri Ghazali Shafie (King Ghaz), Tun Ghaffar Baba dan Tan Sri Razaligh Hamzah (Ku Li).Begitu juga semasa Tun Dr. Mahathir menjadi Perdana Menteri, nama juga Tun Musa Hitam muncul untuk menjadi penggantinya tetapi tidak kesampaian. Selepas Musa Hitam mengundur diri, tiga orang yang bermula huruf ‘A’ menjadi timbalannya bermula dengan Tun Abdul Ghaffar Baba, Dato’ Seri Anwar Ibrahim dan akhirnya Tun Abdullah Ahmad Badawi berjaya menjadi pengganti kepada Mahathir bagi mengisi huruf ‘A’.
Beberapa nama yang mungkin layak untuk menjadi Perdana Menteri seperti Tun Dr. Ismail, Musa Hitam, King Ghaz dan Ku Li terlepas peluang menjadi Perdana Menteri kerana tidak secocok dengan Teori RAHMAN.
Sama ada secara kebetulan ataupun tidak, pencipta teori RAHMAN berjaya dibuktikan selepas Dato’ Seri Najib Tun Razak menjadi Perdana Menteri sejak April, 2009 yang lepas. Selepas teori RAHMAN ini berjaya dibuktikan semasa kepimpinan BN menerajui pemerintahan negara, pengkaji-pengkaji politik Negara mulakan satu lagi pencarian baru, apakah teori perlantikan PM selepas ini?
Apakah teori RAHMAN untuk pusingan kedua akan berlaku? Atau terdapat satu teori lain akan muncul sedikit masa lagi. Kita nantikan perkembangan selanjutnya.Muhyidin bukan Pengganti Najib?
Sembang-sembang politik yang popular dewasa ini menyebut, Tan Sri Muhyidin bukan pengganti Najib sebagai Perdana Menteri Malaysia yang seterusnya. Sebab yang paling popular yang menjadi perkiraan mereka, era pemerintahan BN akan berakhir dengan kepimpinan Najib dalam pilihanraya umum ke-13 nanti. Tetapi sesetengah mereka yakin BN masih mampu memenangi pilihanraya ke-13 nanti kerana orang Melayu tidak ada pilihan lain terpaksa bergantung kepada UMNO kerana PAS masih tidak diyakini mampu memenuhi aspirasi orang-orang Melayu.
Apatah lagi dengan parti multi-racial seperti PKR. Seorang penganalisis politik UMNO menjangkakan, pertandingan dalam UMNO akan menjadi lebih sengit selepas PRU ke-13 nanti dan Muyhidin dijangka akan kecundang. Pertandingan baru-baru ini Muhyidin terselamat kerana Najib masih memerlukan beliau untuk meredakan pergolakan dalaman UMNO.
Beliau memberitahu saya, nasib Muhyidin akan sama seperti nasib Tun Musa Hitam sebelum ini. Kedudukan beliau hanya untuk memanaskan kerusi Timbalan Perdana Menteri untuk seketika jika beliau tidak bertindak dari sekarang untuk menyelamatkan kedudukannya. Tempatnya dijangka akan digantikan oleh Datuk Hishamuddin Tun Hussein sebelum diambilalih oleh Datuk Mukhriz Tun Dr. Mahathir untuk membentuk satu legasi baru pusingan kedua politik Malaysia yang sedang dirancangkan oleh pihak-pihak elit politik negara.
Konspirasi politik kedua keatas Dato’ Seri Anwar Ibrahim dalam menghadapi tuduhan liwat oleh Saiful Bukhari mungkin menjadi sebahagian dari plot yang dirancangkan oleh pihak-pihak berkepentingan. Bagi mengelakkan perkara ini terus berleluasa, satu reformasi kedua politik negara akan berlaku tetapi rakyat masih belum bangkit menjayakannya seperti tahun 1998 dan 2008 yang lepas.
Dalam tahun 1998 hanya orang Melayu yang bangkit. Begitu juga dalam tahun 2008 hanya bukan Melayu yang bangkit. Kali ini jika semua rakyat bangkit menuntut reformasi menyeluruh dalam kepimpinan politik negara, BN hanya akan menjadi sejarah dengan Najib sebagai Perdana Menteri terakhir era BN.
Dua nama yang sedang disebut-sebut untuk menjadi Perdana Menteri pilihan rakyat berbagai kaum kali ini adalah Anwar Ibrahim dan Tengku Razaligh Hamzah. Anwar Ibrahim telah melalui zamannya dalam pilhanraya 2008 yang lepas dengan Pakatan Rakyat/Barisan Alternatif dan Tengku Razaligh pun telah melalui zamannya dalam pilihanraya 1990 melalui Gagasan Rakyat/Angkatan Perpaduan Ummah.
Melihat kepada sambutan kepada Ku Li dalam taklimat Royalti Petroleum baru-baru ini, saya yakin sentuhan Ku Li dalam politik negara masih berbisa. Jika Ku Li berjaya menjadikan Kelantan sebagai pangkalan politiknya.Jika beliau diperlukan oleh UMNO/BN sebagai Perdana Menteri, nescaya nasibnya dalam UMNO/BN tidak seperti sekarang ini memandangkan rakan-rakannya dalam team B dulu seperti Abdullah Badawi dan Rais Yatim serta yang lain-lain lebih bernasib baik berbanding dengan beliau sendiri.
Satu sahaja peluang yang masih terbuka untuk Ku Li dan Anwar menjadi PM sekarang ini adalah dengan bersatu menggerakan peluang Gagasan Pakatan Rakyat berbanding melalui UMNO/BN kerana pintu tersebut telah hampir tertutup baginya.
Jika Ku Li menjadi Perdana Menteri yang pertama Pakatan Rakyat, kemudian diikuti oleh Anwar Ibrahim sebelum Hadi Awang mengambilalih untuk menjadi Perdana Menteri seterusnya, peluang TEORI RAHMAN pusingan kedua era Pakatan Rakyat boleh menjadi kenyataan.

HANIPA MAIDIN : ANWAR - VICTIM OF OVERZELOUS PROSECUTIONS

setuju sangat sangat....bila dah nama Anwar Ibrahim, apa - apa pun boleh dilakukan, Petai (l) sodu mee habis habis.
FEB 9 — I have been practising as a criminal lawyer for almost 16 years. I have considerable experience defending accused persons who were being charged for sexual related crimes. My experience tells me that the prosecution will never charge a person for an offence of rape or sodomy if the medical evidence is not favourable to them. It is almost an accepted rule of practice or a legal norm, as far as the offence of rape or sodomy is concerned, medical evidence operates as oxygen to the prosecution.

It seems to me that such a practice is no longer adhered to in the current ongoing trial of Anwar Ibrahim. When the accused person is Anwar Ibrahim the rule of game is suddenly and drastically changed. When Anwar is charged the prosecution no longer seems to gauge the strengths of its case on the available evidence they have. When Anwar Ibrahim is tried the prosecution will, come what may, happily proceed with the trial regardless whether it has fragile evidence or no evidence at all against him !!

The only crime Anwar committed in this case is for having the name, Anwar Ibrahim.
I believe that if another person by the name of Ibrahim Anwar or any other Ibrahims allegedly sodomised Saiful the prosecution would not charge such a person when provided with the medical report prepared by doctors in Pusat Rawatan Islam ( Pusrawi ) and Kuala Lumpur General Hospital respectively.

Both reports, as I was told by lawyers in Anwar’s legal team, contain a very damning evidence against the prosecution in that they unequivocally state that there are no visible signs of penetration of Saiful’s anus. As far as the report of the Kuala Lumpur General Hospital is concerned, it was duly signed by three doctors. So what the prosecution have in their possession are the reports certified by four doctors ( one from Pusrawi and three from KLGH ) apparently dismissing the prosecution’s theory that Saiful was ever sodomised by Anwar.

People may ask why the AG, despite such a damning evidence against the prosecution, is still adamant, and not withdraw the charge against Anwar?The reason is pretty obvious, that is the accused person is Anwar Ibrahim. When Anwar Ibrahim is tried the prosecution will not care even with the existence of a hundred medical reports exonerating Anwar Ibrahim of any sexual offence.

To the layman, this question may crop in their mind. Is the medical evidence really significant in Anwar’s trial ? The answer to that is a resounding yes. As I have indicated earlier the medical evidence is oxygen to the prosecution’s case. The prosecution case dies the moment oxygen disappears or malfunctions.

It is a rule of prudence, as the lawyers call it, in any sexual related crimes, the evidence of the complainant per se is legally insufficient . Such evidence must be corroborated by other independent evidence.

Translated into Anwar’s trial, Saiful’s evidence alone is not sufficient to convict Anwar. His evidence must be corroborated. Of course a corroboration is not needed for all crimes. But in sexual offences, corroboration is highly significant in order to support the factum ( act ) of the alleged sodomy.

Why corroborative evidence is necessary in sexual related cases ? The legal practitioners say such evidence is needed because of the nature of such offences. In any rape or sodomy case it is relatively easy to allege that a crime has been committed by such and such person but it is on the other hand difficult for any person who is being charged to such offences to disprove such an allegation.

We can see clearly even before the court passes any verdict on Anwar, judging from the media coverage which appeared in Utusan and other BN’s controlled media, Anwar is as good as being found “guilty” by these so called juries. The media coverage was so vicious that one wonders whether Anwar’s, or for that matter, his family’s dignity brings any value to this irresponsible media.

The law says if you accuse somebody of committing a sodomy against you the law requires you to furnish corroborative evidence to support your allegation. That is why even in Islamic criminal law if a person is charged for sodomy, the prosecution must bring four witnesses who really see the actual penetration. That shows Islam also takes into account corroborative evidence.

And in Islam the standard of proof in sodomy case is very high indeed that is the prosecution must prove its case beyond any shadow of doubt, and the present standard of proof in civil law which is only beyond reasonable doubt. Thus in Islam any iota of doubt must be ruled in favour of the accused based on the maxim that “ the offence of hudud is withdrawn whenever iota of doubt is present ” . Islam holds the view that it is much wiser for a judge to err in acquitting 10 guilty persons rather than to err in convicting even one innocent person !!

In sodomy , like a crime of rape, the essential element which needs to be proven by the prosecution is the act of penetration itself. In Islamic law the same element also needs to be established by the prosecution in certainty.

Now how is the prosecution able to prove the element of penetration if they do not produce the medical reports/evidence? And how are the medical reports in Anwar’s trial useful to prosecution if they clearly say no visible signs of penetration to Saiful’s anus. The medical evidence is supposed to corroborate Saiful’s evidence but apparently in this case the same medical reports in fact exonerate Anwar Ibrahim. The rule is so simple : no penetration no prosecution. But the AG seems to hold the view that yes, no penetration but mind you we still have persecution to do!!

It is beyond question if Anwar is tried under the Islamic law, the charge, as it is presently framed against him, will never see the light of the day. Seeing the oral testimony of Saiful so far one cannot avoid to jump to the conclusion that it was a groundless or trumped up charge.
The AG should exhibit a high level of professionalism and integrity in the Anwar’s case. Intellectual honesty dictates that the prosecution should withdraw the charge against Anwar Ibrahim. Period. To prosecute a person in the absence of credible evidence is definitely tantamount to a prosecutorial misconduct and wastage of public funds.

The day that AG becomes the tool of the crooked politicians should have passed after the election tsunami in 2008.

“Biar saya lanjutkan apa yang pernah saya katakan mengenai status Menteri Besar”Perlembagaan adalah undang-undang tertinggi di negara ini. Ia merupakan asas dan sumber kepada kuasa undang-undang, dan Raja-Raja telah bersumpah untuk mempertahankannya.
Menurut Perlembagaan, Dato’ Seri Ir Haji Mohammad Nizar Jamaluddin adalah Menteri Besar sehinggalah beliau meletak jawatan atas kerelaannya, atau disingkirkan melalui undi tidak percaya menerusi persidangan dewan undangan negeri.
Perlembagaan tidak mempunyai sebarang peruntukan untuk menyingkirkannya melalui cara lain, termasuk melalui petisyen atau arahan daripada mana-mana pihak berkuasa.Dua prinsip perlu dijelaskan:
Pertama, kerajaan yang memerintah diasaskan menurut undang-undang dan prinsip yang terdapat dalam Perlembagaan. Inilah yang membezakan di antara kerajaan yang dibentuk secara sah dan yang dibentuk secara kekerasan melalui undang-undang rimba.
Kedua, kerajaan yang dibentuk secara sah menurut Perlembagaan memperolehi kuasanya daripada mandat yang diberikan rakyat, hanya melalui cara itu. Mandat diberikan oleh rakyat kerana kerajaan itu dibentuk menurut Perlembagaan, dan pemimpin-pemimpinnya mereka pilih melalui pilihan raya yang bebas dan adil.
Kita perlu menguji mandat ini secara berkala. Pada waktu-waktu penting seperti apabila sesebuah kerajaan akan dibentuk atau dibubarkan, Perlembagaan memperuntukkan kaedah ujian yang formal dan definitif untuk mengukur sejauh mana mandat rakyat diperolehi oleh kerajaan berkenaan.
Jadi, kita adakan pilihan raya untuk menguji sejauh mana sokongan di kalangan rakyat yang diperolehi oleh seseorang calon pimimpin. Persoalan dikemukakan dalam pilihan raya yan dikawal oleh undang-undang dan persetujuan yang mendahului masa.Jika pilihan raya tidak diadakan, atau sekiranya pilihan raya itu diragui kebebasan dan keadilannya, maka persoalankeabsahan kepimpinan tidak dapat ditentukan.
Walau seramai mana pun orang berarak dan meneriakkan nama anda, semuanya itu tidak diambil kira. Anda perlu membuktikan bahawa anda mempunyai sokongan pengundi melalui pilihan raya yang bebas dan adil.
Sama juga, Perlembagaan menyediakan satu kaedah definitif untuk menguji sama ada seseorang Menteri Besar atau Perdana Menteri masih mempunyai majoriti di Dun atau Parlimen. Kita akan kemukakan undi tidak percaya di Dun atau Parlimen.
Apa yang akan diambil kira nanti ialah keputusan persidangan tersebut. Ia tidak mengambil kira sebanyak mana akuan bersumpah, peralihan sokongan, sidang media dan perisytiharan yang dibuat. Ia juga tidak mengambil kira berapa banyak bentuk pengiklanan, pameran, tarikan dan tenaga yang ditanggung bagi menghadapi persoalan tersebut.
Bagi menguji secara formal mandat kerajaan sekarang, sama ada di Perak, Sabah atau kerajaan Persekutuan, persoalan perlu dikemukakan kepada rakyat melalui pilihan raya negeri, atau menerusi persidangan melalui undi formal di dewan. Inilah ujian-ujian yang diambil kira dalam demokrasi berperlembagaan kita.
Inilah juga apa yang diertikan sebagai demokrasi berparlimen. Untuk menyingkir atau membentuk kerajaan melalui cara selain itu akan menyalahi Perlembagaan, melunturkan kuasa undang-undang dan berhadapan dengan risiko pembentukan kerajaan yang haram.
Pihak berkuasa yang sah hanya boleh ditubuhkan melalui kaedah demokratik seperti yang disebut oleh Perlembagaan. Kuasa yang sah dan betul berbeza sepenuhnya daripada kuasa buas yang boleh dibeli, jual atau dirampas menggunakan kekuatan.

MAHKAMAH ZAKI

Perlu faham kepada 2 faktor isu,
i. Hak Asasi
ii. Politik
Jika berdasarkan kepada keputusan hak asasi, nampak macam mahkamah independent, tapi jika berdasarkan kepada politik, kita boleh lihat sendiri. Perak dah terlepas, Nizar kalah, selepas ini DSAI ....?
Tun Suffian kata 50 tahun, saya kata 100 tahun pun belum tentu.... selagi UMNO itu menjadi pemerintah.

Mahkamah Era Tun Zaki : ZAID IBRAHIM
Selepas pemecatan hakim-hakim oleh Dr Mahathir Mohamad pada tahun 1988, Allahyarham Tun Suffian Hashim telah menyatakan bahawa badan kehakiman Malaysia akan hanya pulih dari segi kewibawaan dan kepercayaan rakyat dalam masa 50 tahun akan datang. Daripada langkah dan tindakan yang dilakukan oleh Ketua Hakim Negara Tun Zaki Azmi, saya melihat efisiensi Mahkamah sudah meningkat manakala kes-kes tertunggak banyak diselesaikan . Ini adalah satu perkembangan yang baik. Saya harap Majlis Peguam akan terus memberi kerjasama kepada badan kehakiman supaya Mahkamah kita lebih mampu menyelesaikan masalah rakyat dengan lebih cepat dan adil.

Hakim-hakim Mahkamah Tinggi juga telah menunjukkan sikap ‘bebas” dan berani dalam beberapa kes sejak kebelakangan ini. Bebas dan berani ini dalam konteks kehakiman ialah berani membuat keputusan berdasarkan fakta dan undang-undang serta Perlembagaan tanpa mengira sama ada keputusan itu popular atau tidak, sama ada dipuji atau dicemuh orang ramai. Hakim-hakim tidak sepatutnya mengambil kira sama ada pembangkang atau kerajaan menyokong keputusannya; keputusan yang bijak dan adil adalah tanggungjawab mereka.
Antara contoh-contoh ketegasan Mahkamah Tinggi membuat keputusan yang berani dan bebas baru-baru ini adalah:

• Kes Mahkamah Tinggi yang membenarkan penggunaan perkataan “Allah” dengan syarat tidak disalahgunakan oleh majalah Herald milik Gereja Katolik Malaysia;• Kes Mahkamah Tinggi di Bintulu yang mengiktiraf hak Orang Asal Sarawak berhubung tanah adat (NCR); dan• Kes Mahkamah Tinggi di Kucing yang mengiktiraf konsep adat Melayu “serah” dalam tuntutan pampasan penat lelah dalam usaha membangunkan tanah.

Mahkamah Persekutuan juga membuat keputusan yang tepat dalam soal “indefeasibility of title” dalam Kanun Tanah Negara bila mereka menolak keputusan awal yang sungguh tidak masuk akal. Mahkamah sekarang nampaknya lebih berwibawa jika dibandingkan dalam tahun-tahun 1990an daulu.

Kini apa yang ditunggu oleh rakyat ialah sama ada Mahkamah kita akan berani dan bebas dalam membuat keputusan yang adil dan tepat dalam kes-kes “politik”. Kes-kes ini akan menentukan sama ada hakim-hakim akan benar-benar bebas atau masih terikat dengan cara lama waktu zaman Mahathir dahulu. Cara lama ialah di mana beberapa hakim “sub standard” digunakan untuk membuat keputusan yang memihak kepada kerajaan atau orang-orang tertentu sahaja dengan mengenepikan prinsip undang-undang dan Perlembagaan tanpa rasa malu.

Sebab itulah keputusan kes Menteri Besar Pakatan Rakyat lawan Menteri Besar Barisan Nasional di Perak minggu depan akan menjadi penentu sama ada Mahkamah era Tun Zaki akan berbeza dengan era sebelum ini. Ia akan menentukan sama ada amalan demokrasi berperlembagaan dan kedaulatan undang-undang (rule of law) akan wujud semula di Malaysia.
Kalau Menteri Besar Mohd Nizar Jamaluddin yang dipilih oleh rakyat dalam pilihan raya umum 2008 menang dalam kes ini, maka kita yakin pemulihan Mahkamah telah bermula dan roh arwah Tun Suffian tidak perlu menunggu 50 tahun lagi untuk menyaksikan pemulihan badan kehakiman di Malaysia. Sebaliknya, kalau seorang lagi yang telah merampas kuasa melalui politik melompat yang diisytiharkan menang, maka kita akan kembali kepada zaman perundangan gelap seperti suatu masa dahulu.

SAIFUL & THE ARTS OF KEMUT : ZACK RAMBLES

Patah balik kebelakang zaman mendiang Florence Griffith Joyner, pelari pecut wanita USA yg glamour tu. Berbadan muscular dengan pecutan power. Dia ni mmemang diketahui umum dikalangan atlet & pemegang tampuk kuasa persatuan atlet seluruh dunia mengambil steroid tetapi tidak boleh dibuktikan walaupun dibuat urine test.
Tetiba timbul satu idea & pandangan. Ditanya oleh seseorang "pernah tak you all terfikir kenapa dia ni bermake - up dan berkuku panjang ketika bertanding? Ada yg kata utk glamour & cantik. Itu hanyalah perkara zahir kata yang bertanya. Jawapannya ialah kuku panjang disimpan bertujuan utk menyuntik belon yang berisi urine bersih yang disimpan didalam kemaluannya. That's why you all tidak boleh trace steroid didalam badan dia."
Akhirnya, akibat takut atau sebaliknya, minah Florence Griffith ni pun umum lah persaraannya dalam dunai olahraga. Beberapa tahun lepas itu dia pun menemui ajal dan ada yang mengatakan ianya berpunca dari kesan pengambilan dadah berlebihan didlm badannya.
Moral of the stories, macam kata Zack Rambles, it's about how you kemut. Maknanya kalau sesiapa nak mendalami teknik kemut, bolehlah rujuk dengan SeiPool. 48 jam boleh simpan air mani dlm juboq walaupun dah berak..hehehehehe

Saiful claimed in his police report of 28th June 2008, made at Hospital Kuala Lumpur (HKL), that he was sodomised by Anwar on the afternoon of Thursday 26th June 2008 at a condominium in Bukit Damansara. Saiful reported to the hospital on the 28th (over 48 hours later)and strangely our good and efficient Police found Anwar's semen and DNA still in the anus!
Let us assume what Saiful claimed is true. That means he avoided shitting for the two days (farting included) and did not washed his anus nor bathing to avoid spilling/overflowing the semen. As Anwar's semen is the most important evidence to collect DNA, he would have to "kemut" or vacuum-up (sorry, i can't find the right English word for kemut) for two days. He would also have to wear pampers or a tight underwear and not changing it for the two days to avoid spilling the semen.
By the time the doctor swipe his anus to fished for the remaining semen, his anus would have smell so bad and his stools would have harden up and become constipate. That is why he complained to the Burmese Doctor at Pusrawi that he had pain in his anus for a few days and that a “plastic” item had been inserted. The plastic thing is actually his harden stool !!
So folks, after this whole episode is done with, somebody should interview Saiful and learn the art of Kemut from him. It would be a very useful knowledge for our ladies !!

ANWAR IBRAHIM : KONSPIRASI NOMBOR 2

4 orang doktor kata tiada tusukan, masa perbicaraan Pendakwa kata ada kesan air mani kat luar juboq Seipool. Laporan dibuat 2 hari selepas "kena tusukan" batang Anwar. Persoalannya ialah adakah Pendakwa cuba nak bagi tau yg Seipool ni tak berak dalam masa 2 hari? Atau mungkin Seipool tidak cuci berak selepas berak? Atau adakah batang konek Anwar terlalu kecil sampai doktor tidak boleh kesan kesan tusukan.

Turut didedahkan pada Rabu 25hb Jun 2008, sehari sebelum serangan seksual terakhir pada hari Khamis keesokan harinya, Saiful telah bertemu dengan pegawai polis berpangkat tinggi Penolong Kanan Komisioner SAC Rodwan Mohd Yusof (waktu iti Timbalan Pengarah Jabatan Siasatan Jenayah Pasukan Polis DiRaja Malaysia, sekarang Ketua Polis Melaka) di Hotel Concorde, Kuala Lumpur di bilik bernombor 619.

Sivarasa Rasiah

Hanya sebelas tahun semenjak Anwar Ibrahim dipecat dari jawatan timbalan perdana menteri, beliau menerima tamparan dengan dakwaan liwat dan seolah-olahnya tuduhan rasuah (penyelewengan kuasa). Beliau berdepan dengan dua perbicaraan yang dikutuk seluruh dunia sebagai perbicaraan tidak adil dan bermotivasikan kepentingan politik pihak tertentu. Hasilnya beliau menghabiskan enam tahun dalam tahanan di Penjara Sungai Buloh, dikurung bersendirian selama pemenjaraan hanya dibenarkan bertemu dengan ahli keluarga dan para peguam sahaja. Akhirnya bekas Perdana Menteri Dr. Mahathir Mohamad mendapat hukuman setimpal dengan berat hati dipaksa bersara pada bulan Oktober 2003. Kemudiannya Anwar dibebas dan dilepaskan pada 2 haribulan September 2004 pada tahap terakhir rayuannya di mahkamah mengubah penghakiman kes liwatnya.

Sekarang mimpi ngeri itu bermula lagi. Pada 16 Julai 2008, Anwar ditangkap atas tuduhan kes liwat yang baru, selepas suatu laporan polis dibuat oleh Saiful Bukhari, pembantu berpangkat rendah dalam pejabatnya pada 28 Jun 2008. Anwar berkata tuduhan ini, sekali lagi bermotifkan politik, sebagai cubaan terbaru untuk menghalang kerjaya politiknya yang kembali bangkit mendadak kegemilangannya. Ramai orang di dalam dan di luar negara bersetuju dengan penilaian ini.

Kes terbaru ini hanyalah ulang tayang skrip lama dengan para pelakon yang baru - skrip sekarang ini juga menampilkan episod-episod campurtangan politik, kecurangan dan penyelewengan para pegawai di pejabat Peguam Negara dan pihak polis, penipuan bukti-bukti yang muncul daripada suatu konspirasi politik untuk menghentikan kerjaya cemerlang politik Anwar.

Kes hairan yang benar-benar pelik

Terdapat banyak fakta terhadap dakwaan yang dibuat Saiful dan tindak tanduknya yang sudahpun berada dalam pengetahuan orang ramai. Fakta-fakta ini bercakap dengan sendirinya. Secepatnya ia menunjukkan betapa tidak kukuhnya kes yang direka-reka ini, selain bertujuan menjatuhkan Anwar.

Saiful mendakwa dalam laporan polisnya bertarikh 28 June 2008 di Hospital Kuala Lumpur ("HKL") yang dia diliwat Anwar pada tengahari Khamis 26 Jun 2008 di sebuah kondominium di Bukit Damansara. Saiful bercerita kepada pihak polis dalam kenyataannya yang mendakwa dia telah diserang paksa sebanyak 8 ke 9 kali tanpa kerelaan hatinya oleh Anwar sepanjang dua bulan yang berlalu itu. Dalam laporan polisnya dua hari kemudian pada 28 Jun 2008, dia mendakwa kejadian liwat ini memang berlaku tanpa kerelaan hatinya. Cerita Saiful ini menimbulkan kecurigaan kenapa dia sebagai kononnya "si mangsa"yang dipaksa liwat 8 ke 9 kali tanpa kerelaan hatinya, selama dua bulan tetapi tidak membuat sebarang aduan kepada pihak berkuasa. Sepanjang waktu itu dia berhubungan secara biasa dengan Anwar dan kesemua kakitangan di pejabat Anwar Ibrahim.

Turut didedahkan pada Rabu 25hb Jun 2008, sehari sebelum serangan seksual terakhir pada hari Khamis keesokan harinya, Saiful telah bertemu dengan pegawai polis berpangkat tinggi Penolong Kanan Komisioner SAC Rodwan Mohd Yusof (waktu iti Timbalan Pengarah Jabatan Siasatan Jenayah Pasukan Polis DiRaja Malaysia, sekarang Ketua Polis Melaka) di Hotel Concorde, Kuala Lumpur di bilik bernombor 619. Apabila ditanya wartawan tentang pertemuan ini, Rodwan tidak memberikan sebarang komen. Rodwan telah memainkan peranan penting bersama pasukan polis dalam kes Anwar tahun 1998/99 dahulu. Rodwan terkenal dengan peranannya mengambil sampel darah Anwar untuk ujian DNA tanpa mengikut lunas undang-undang. Dia juga terkenal dengan tuduhan meletakkan kesan DNA yang direka-reka pada tilam yang diusung ke mahkamah. Sewaktu perbicaraan pertamanya pada tahun 1998, bukti DNA tidak dapat dipakai hinggakan hakim Augustine Paul yang jelas berat sebelah terpaksa membuang bukti tersebut daripada membantu kes pendakwaan.

Umum juga telah didedahkan "si mangsa" ini telah juga bertemu dengan Perdana Menteri sekarang (waktu itu masih Timbalan Perdana Menteri) beberapa hari sebelum kejadian yang didakwa itu berlaku. Apa yang lebih menarik lagi tentang pendedahan ini Najib pada awalnya menafikan pertemuan dengan Saiful kepada pihak media, tetapi kemudiannya mengakui, menjelaskan pertemuan itu berlangsung kerana Saiful (gagal dari universiti, tidak habis belajar) meminta bantuan Najib untuk mendapatkan biasiswa. Selepas itu barulah Najib memberi tahu pihak media bahawa Saiful diliwat Anwar dan dalam pertemuan tersebut Saiful kelihatan cukup traumatik.

Tindak tanduk Saiful selepas kononnya dipaksa liwat pada hari Khamis turut menimbulkan tanda tanya. Pagi besoknya, Saiful ke pejabat Anwar seperti biasa. Dia tidak mengadu kepada sesiapapun dan muncul dalam keadaan yang normal.Pada sebelah petangnya dia menghadiri acara anjuran Anwar Ibrahim Club di rumah Anwar, yang mana Anwar sendiri turut hadir. Di sana dia membantu menghidangkan kopi kepada sedozen orang yang hadir, tanpa memperlihatkan tanda-tanda takut atau cemas, dia mampu berdiri dan duduk tanpa menunjukkan tanda-tanda ketidak selesaan.

Pada hari Sabtu berikutnya, pada sebelah tengahari, kira-kira jam 2 petang, Saiful memutuskan untuk pergi ke hospital swasta Pusat Rawatan Islam (PUSRAWI) di Jalan Tun Razak. Di situ, dia mengadu kepada Dr. Osman yang dia merasa sakit di dalam lubang duburnya selama beberapa hari dan kelihatannya dia merasa seperti ada bahan "plastik" yang dimasukkan. Pemeriksaan protoskopi (menggunakan alat protoskop yang bertujuan memeriksa hujung lubang dubur) oleh Dr. Osman menunjukkan tidak ada tanda-tanda penembusan atau kemasukan dan keadaan normal dubur dan rektum hujung usus.

Selesai pemeriksaan, dia memberitahu Dr. Osman yang dia diliwat oleh VIP (orang kenamaan) dan Saiful telah dinasihatkan untuk mendapatkan pemeriksaan di hospital kerajaan. Meskipun HKL hanyalah terletak di seberang jalan, Saiful mengambil masa selama dua setangah jam untuk sampai ke sana. Di HKL, dia melaporkan yang dia diliwat, dia kemudiannya diperiksa oleh oleh tiga orang doktor pakar, yang mana bukanlah suatu prosedur yang biasa. Ketiga-tiga doktor tersebut dalam laporan rasmi mereka menyebut, "tidak ada rumusan hasil pemeriksaan klinikal yang dengan pasti dapat mencadangkan penembusan ke dalam lubang dubur ..." sekali lagi ia menguatkan kesimpulan yang dibuat Dr. Osman.

Sesiapapun yang menjadi penyiasat dengan sifat waras akan memahami bahawa pertuduhan liwat tidak akan ke mana-mana dalam keadaan bukti perubatan sejelas itu. Tiada seorangpun penyiasat yang waras akan meneruskan kes pendakwaan. Di sini kita melihat perkara yang sebaliknya berlaku. Pasukan penyiasat bersungguh-sungguh, biarpun bukti perubatan menunjukkan tidak ada penembusan terhadap lubang dubur. Sifat hasad berniat jahat dalam penyiasatan mengukuhkan lagi kewujudan motif politik disebalik tindakan mereka.
Penyiasatan kes ini diteruskan biarpun hasil laporan pemeriksaan perubatan telah diserahkan dengan serta-merta kepada para penyiasat polis. Spesimen yang diambil dengan pengelap daripada Saiful menimbulkan syak wasangka kerana ia mengambil masa dua hari untuk sampai ke makmal untuk dianalisa. Sekarang kita tahu bahawa pihak pendakwaan akan bergantung kepada bukti DNA dalam cubaan untuk membuktikan Anwar terlibat dalam tindakan meliwat Saiful tanpa kerelaannya.

Bagaimana seorang tua dengan sakit belakang dapat memaksa seorang jejaka yang tinggi dan tegap berusia 24 tahun, boleh menjadi soalan yang menarik untuk dijawab para pemerhati politik sepanjang perbicaraan ini.

Soalan lain yang menarik ialah dalam keadaan bukti kukuh perubatan yang menyatakan pemeriksaan klinikal tidak menemui malah untuk mencadangkan penembusan, kurangnya wibawa laporan DNA yang cuba menunjukkan DNA Anwar ditemui didalam lubang dubur Saiful. Perlu diingatkan bahwa bukti DNA sangat mudah untuk direka atau ditambah-tambah, khususnya jika kerja-kerja mereka-reka tambah bukti ini dilakukan oleh para penyiasat yang sama dalam perbicaraan 1998 dahulu.

Contoh-contoh bukti yang direka-reka bagi mengenakan Anwar

Ini bukan kali pertama, kes yang melibatkan Anwar untuk fenomena bukti yang direka-reka muncul. Kes 1998 dan 1999 penuh dengan kejadian pengakuan yang dirancang, bukti DNA yang direka-reka dan penyembunyian bukti pada pihak polis dan para pendakwa kanan yang terlibat.
Beberapa contoh dapat diberikan. Gani Patail merupakan salah seorang Pendakwaraya Kanan dalam kes Anwar pada tahun 1998 telah didedahkan pada tahun ini sebagai mereka-reka bukti perubatan dalam bentuk laporan perubatan. Ianya berhubung penyiasatan serangan terhadap Anwar pada malam 20 September 1998 bilamana Anwar telah diserang secara ganas oleh Rahim Noor. Setelah dunia melihat mata lebam Anwar, wujud desakan dan barulah diikuti dengan penyiasatan polis. Pegawai Penyiasat dalam kes tersebut, Dato Mat Zain telah mengesahkan hal ini dalam suratnya kepada SPRM (Suruhanjaya Pencegahan Rasuah Malaysia) bertarikh 15 April. Menurut surat itu, Gani Patail dengan bersungguh-sungguh mereka-reka bukti laporan perubatan dengan dibantu Musa Hassan (sekarang Ketua Polis Negara) dalam cubaan untuk cuba mencadangkan kecederaan Anwar dilakukan oleh dirinya sendiri. Dr. Mahathir kemudiannya mengumumkan kepada awam tentang kecederaan tersebut dilakukan oleh Anwar sendiri.

Pembentukan bukti rekaan terhadap Anwar juga berlaku dalam kes-kes dan orang-orang yang lain. Gani Patail didakwa terbabis mengancam Nallakaruppan dengan hukuman bunuhbagi memaksa dirinya memberi keterangan palsu terhadap Anwar. Hal ini didedahkan dalam akuan bersumpah yang dibuat peguam Nallakaruppan, Manjeet Singh Dhillon yang merupakan saksi langsung cubaan mengugut oleh Gani Patail bagi mendapatkan bukti palsu terhadap Anwar.
Hakim Mahkamah Persekutuan Steve Shim dalam kes Zainur Zakaria lawan PP [2001] 3 CLJ ada menyatakan bahawa permohonan Anwar untuk membatalkan Gani Patail dan Azahar sebagai pendakwaraya kanan kerana penglibatan mereka dalam mengancam Nallakaruppan dengan hukuman bunuh bagi mendapatkan bukti rekaan yang diinginkan:

”Dalam keadaan ini, apakah beliau ("Anwar") dianggap tidak wajar atas asas ianya melampaui keraguan munasabah untuk membuat aduan bahawa tindak tanduk Peguam Negara (Gani Patail) sewaktu pertemuan pada 2 Oktober 1998 dalam cubaan memaksa Nalla untuk mereka-reka bukti bagi menyempurnakan tuduhan terhadap Anwar untuk kes kesalahan seksual yang lain?"

Namun Hakim Augustine Paul tidak bertindak untuk membatalkan kelayan Gani Patail dan Azahar. Malah Augustine mendapati peguambela Anwar, Zainur Zakaria bersalah sebagai menghina mahkamah kerana memfailkan permohonan pembatalan kelayakan tersebut dan menjatuhkan hukuman 3 bulan penjara. Gani Patail terus mendaki puncak kekuasaan menjadi Peguam Negara. Azahar pula menjadi Hakim Mahkamah Tinggi. Malaysia Boleh!

Sukma, adik angkat Anwar, ditangkap pada September 1998 dan ditahan tanpa ada perhubungan dengan peguam dan keluarga selama 14 hari. Permohonan peguamnya untuk bertemu dengan Sukma ditolak. Dia disiksa secara mental dan fizikal sehinggalah dia membuat pengakuan melakukan liwat dengan Anwar. Pegawai polis yang dinamakan dalam penghakiman Mahkamah Rayuan sebagai bertanggungjawab dalam penyiksaan ini ialah Musa Hassan, sekarang Ketua Polis Malaysia. Pemeriksaan fizikal oleh Dr. Zahari Noor menunjukkan tidak ada bukti penembusan - laporan ini diketahui oleh pihak pendakwaraya yang menyembunyikannya daripada pengetahuan mahkamah, saat Sukma mengaku "bersalah" hanya berasaskan pengakuan yang dipaksakan itu. Peguam yang dilantik keluarga Sukma tidak dibenarkan bersuara mewakili anak guamnya setelah dibantah oleh pihak pendakwa raya (Gani Patail and Yusuf Zainal Abiden).

Mahkamah Rayuan dalam penghakiman bertulisnya pada Jun 2006 dalam kes Sukma Darmawan Sasmitaat Madja v PP [2007] 4 CLJ 697] menyatakan:

"Di sini kita ada kes kelakuan sumbang pihak pendakwaan dengan secara sengaja menyembunyikan bukti yang memenangkan pihak pembelaan. Tidak ada lagi kes ketidak adilan sejelas ini, apabila pengakuan bersalah didakwa didapatkan dengan cara tekanan yang tidak sah di sisi undang-undang."

Penangkapan dan penahanan Dr Munawar Anees juga sama seperti yang terjadi kepada Sukma, dia ditahan tanpa dapat berhubung dengan peguam dan keluarga, disiksa dan dipaksa membuat pengakuan palsu melakukan liwat dengan Anwar. Malang bagi dirinya, kesemua mahkamah yang dirayu tidak memenangkan kesnya.Hakim-hakim seperti Low Hop Bing J di Mahkamah Rayuan bersama hakim Zaki Tun Azmi ( Ketua Hakim sekarang), Zulkefli Makinudin J. dan Nik Hashim J di Mahkamah Persekutuan telah memastikan permohonan Dr Munawar untuk mendapat keadilan dan membolehkan kesnya dibuka semula telah ditamatkan. Mereka memastikan Dr Munawar tidak berupaya untuk mendedahkan pengalaman pahitnya pada tahun 1998 di tangan pihak polis, pendakwaan dan mahkamah dalam suatu perbicaraan yang baru. Permohonannya untuk menimbal semula keputusan Mahkamah Persekutuan telah ditolak baru-baru ini pada 28 Desember 2009 oleh panel Mahkamah Persekutuan yang dianggotai Arifin Zakaria J., Raus Sharif J. dan Mohd Ghazali Mohd Yusuf.

Pergeseran yang jelas di antara layanan dalam kes Sukma dan kes Munawar pada peringkat rayuan kepada mahkamah yang lebih atas cukup terang dan nyata. Di dalam sistem perundangan jenayah manapun, apabila pengakuan dicabar atas sebab dilakukaan tanpa kerelaan, pihak tertuduh secara automatiknya dianugerahkan peluang mendengar viva voce (melalui saksi-saksi) berhubung dengan kesukarelaannya. Pendinding perundangan ini menjadi amat penting kerana apabila pengakuan bersalah direkodkan berdasarkan pengakuan tanpa rela. Cukup disesalkan mahkamah tertinggi di Malaysia tidak nampak prinsip-prinsip asas keadilan sistem kehakiman ini. Melalui tindakan tersebut, mereka telah mengesahkan jenayah serius yang dilakukan pihak polis dan pendakwaraya terlibat apabila dia ditangkap, ditahan dan disiksa bagi mendapatkan pengakuan palsu dan dipenjarakan selama enam bulan hanya kerana untuk memburukkan nama Anwar dengan perkaitan hubungan perkenalan.

Konspirasi hasad niat jahat dalam kes sekarang ini

Gani Patail sekarang merupakan Peguam Negara di Malaysia. Musa Hassan ketua pasukan polis negara. Kedua-dua nama, secara khususnya Gani Patail, telah didedahkan oleh Mat Zain sebagai mereka cipta bukti palsu, suatu jenayah yang serius, bagi mengenakan Anwar dalam penyiasatan ke “mata lebam” Anwar.

Penyiasatan kes sekarang ini dibawah kawalan polis yang mendapat arahan dari Musa Hassan. Hasad jahat penyiasatan menjadi cukup nyata apabila anggota polis bersenjata dan bertopeng menangkap Anwar kira-kira jam 1 tengahari di rumahnya pada 16 Julai 2008 – ini terjadi kira-kira dua setengah minggu selepas laporan dibuat Saiful. Penangkapan itu sebenarnya langsung tidak perlu dibuat. Ini disebabkan para peguam Anwar sedang mengiringi beliau ke Ibu Pejabat Polis Daerah Kuala Lumpur pada jam 2 petang hari yang sama bagi menghadiri temujanji yang telahpun diatur sebelum itu dan dipersetujui oleh pegawai polis yang ditugaskan merekod kenyataan Anwar.

Namun, beliau ditangkap umpamanya beliau seorang penjenayah yang sedang melarikan diri. Anwar ditahan semalaman di lokap, sekali lagi ianya tidak perlu dan cukup jelas menunjukkan hasad jahat. Beliau dipaksa tidur di atas lantai simen yang dingin, menambah burukkan kecederaan lama bahagian belakangnya. Alasan yang diberikan polis untuk menahan Anwar selama semalaman adalah kerana mereka perlu menyelesaikan untuk mengambil kenyataan beliau – namun permintaan beliau untuk pulang pada waktu yang dijanjikan telah ditolak. Sekarang ia menjadi amat jelas bahawa Anwar ditahan semalaman dilokap kerana percubaan untuk mendapatlan sampel DNA dari tubuh beliau.

Tuduhan Saiful diperkuatkan lagi dengan Saiful mengambil bahagian dalam acara “sumpah lakhnat” di Masjid Negara Kuala Lumpur pada 15 Julai 2008 dengan kehadiran Ustaz Ramlang bin Porigi, salah serang imam di sana. Kemudiannya pada bulan Ogos, Ustaz Ramlang mendedahkan yang dia diarahkan oleh Ketua Jabatan Agama Islam Wilayah Persekutuan Kuala Lumpur (JAIWP) Dato Che Mat bin Che Ali untuk hadir sebagai saksi saat sumpah tersebut berlangsung. Disebabkan dia membuat pendedahan umum berhubung perkara ini, Ustaz Ramlang kemudiannya ditukar ke bahagian “kewangan” (JAIWP). Beberapa bulan kemudiannya dia dikenakan tindakan disiplin.

Campurtangan politik juga ditunjukkan dalam pengendalian aduan qazaf yang difailkan oleh Anwar ke atas Saiful kepada pihak JAIWP pada 9 Julai (qazaf merupakan kesalahan dibawah undang-undang syariah kerana memberi kenyataan fitnah terhadap orang lain, khususnya dalam hubungannya dengan kesalahan seksual). Jabatan penguatkuasaan JAIWP telah menyelesaikan penyiasatannya dalam masa beberapa bulan dan telah merekod kenyataan dari Anwar, Saiful dan saksi-saksi yang relevan. Sehingga ke hari ini JAIWP masih belum mengisytiharkan tidak ada kesalahan yang dilakukan Saiful. Dalam masa yang sama, tidak ada pendakwaan terhadap Saiful yang cuba dibuat. Para pegawai JAIWP telah diarahkan oleh Menteri Persekutuan bertanggungjawab dalam hal ehwal agama Islam untuk tidak mengambil sebarang tindakan terhadap Saiful, atas alasan kes liwatnya masih belum habis berlangsung. Hal ini adalah salah kerana perundangan kedua mahkamah ini adalah terpisah dan indipenden dan sekali lagi ia menunjukkan campurtangan politik.

Hasad jahat dan berat sebelah di pihak pendakwaan; memegang dokumen daripada pihak pembelaan; perbicaraan tidak adil

Perhatian yang serius patut diberikan terhadap hasad jahat dan sikap berat sebelah di pihak pendakwaan. Gani Patail menandatangani sijil pemindahan kes Anwar dari Mahkamah Sesyen ke Mahkamah Tinggi. Yusuf Zainal Abiden, Pendakwaraya Kanan dalam pasukan pendakwaan kes sekarang juga terlibat secara giat dalam kes Sukma dan kes pendakwaan Anwar pada tahun 1998.
Terdapat keprihatinan dengan memberikan sikap berat sebelah dan mala fide atau niat jahat yang ditunjukkan pihak pendakwaan dalam kes-kes sebelum ini, bahawa Anwar tidak akan mendapat perbicaraan yang adil daripada Pendakwaraya Kanan yang mendakwanya sekarang.
Beberapa tindakan berniat jahat telahpun ditunjukkan dalam persoalan pencarian dokumen-dokumen dan bukti dalam kes semasa ini. Permohonan beterusan dari barisan para peguam Anwar untuk mendapatkan dokumen-dokumen yang sesuai bagi mempersiapkan pembelaan seperti kenyataa saksi Saiful dan saksi-saksi lainnya tidak dilayan oleh Pendakwaraya Kanan.
Anwar kemudiannya memohon dokumen-dokumen ini kepada hakim perbicaraan Mahkamah Tinggi. Hakim Zabidin Mohd Diah telah membenarkan permohonan Anwar ini.
Pihak pendakwaraya pula merayu, yang menyebabkan Mahkamah Rayuan mengenepikan penghakiman Mahkamah Tinggi. Rayuan Anwar ke Mahkamah Persekutuan ditolak pada Jumaat 28 Januari 2010. Suatu keputusan yang tidak mengejutkan, dengan melihat pendirian politik yang diambil oleh hakim-hakim Mahkamah Persekutuan dalam kes Dr Munawar.

Fakta menunjukkan rayuan Anwar ke Mahkamah Persekutuan terhadap beberapa hal penting berhubung pengeluaran dokumen itu masih lagi menunggu keputusan. Namun demikian, hakim perbicaraan Mahkamah Tinggi pada 6 Disember 2009 muncul dalam keadaan tertekan untuk menetapkan tarikh perbicaraan lebih awal dan menetapkan perbicaraan dimulakan pada 25 Januari selama sebulan. Hakim yang sama pernah berkata bahawa tahun ini tarikh perbicaraan tidak akan ditetapkan sehinggalah perihal mendapatkan dokumen-dokumen itu ditentukan oleh rayuan ke peringkat mahkamah yang lebih atas.

Keadilan perbicaraan yang bakal dihadapi Anwar telah dipersoalkan dengan penafian dokumen-dokumen penting bagi persiapan pembelaan. Di dalam perbicaraan jenayah pada hampir keseluruhan sistem perundangan, pihak tertuduh akan diberikan, sebelum perbicaraan, kenyataan-kenyataan kesemua saksi dan keseluruhan dokumen yang dikeluarkan oleh kesemua saksi terbabit.
Prosedur ini memastikan keadilan terhadap semua pihak, dan menghalang penangguhan perbicaraan. Meskipun terdapat peruntukan undang-undang sedia ada, namun perbicaraan Anwar akan berjalan seperti cara lama dengan serangan-serangan hendap penghujahan dan pembuktian. Setiap butir-butir perincian kes pendakwaan dan banyak dokumen-dokumen penting akan dilihat kali pertama oleh pihak pembelaan hanya sewaktu perbicaraan berlangsung. Ianya meletakkan pihak tertuduh dan para peguam belanya dalam keadaan tekanan yang tidak adil.

Konspirasi politik

Kunci kepada perbicaraan ini dapat dilihat dengan tindak-tanduk bermotif politik oleh pihak pendakwaan dan kepentingan pihak-pihak yang terlibat, secara khususnya Gani Patail (Peguam Negara sekarang) dan Musa Hassan (Ketua Polis Negara sekarang) serta Perdana Menteri hari ini.

Pakatan Rakyat dan Anwar telah mengkritik mereka secara habisa-habisan di dalam dan di luar parlimen – Peguam Negara Gani Patail dengan perlakuan jenayahnya sendiri di dalam kes penyiasatan “mata lebam”, kegagalannya untuk memastikan pendakwaan bagi banyak kes-kes rasuah yang serius, secara khususnya yang berkaitan dengan jenayah dan rasuah yang didedahkan dalam video klip VK Lingam; juga terhadap hubungan terhadap dakwaan-dakwaan berwibawa keterlibatan KPN Musa Hassan dalam tindakan jenayahnya berserta hubungan rasuahnya dengan ketua-ketua kumpulan kongsi gelap seperti BK Tan dan Goh Cheng Poh.
Kritikan terbuka Anwar terhadap keterlibatan Perdana Menteri dalam kes rasuah pembelian jet Sukhoi dan kapal Selam Scorpene oleh Kementerian Pertahanan telah menjadi rekod umum. Anwar juga berulang kali mendesak Najib membenarkan penyiasatan bebas bagi membersihkan namanya atas dakwaan berwibawa penglibatan dirinya dan isterinya Rosmah dalam pembunuhan terkenal model Mongolia Altantuya Shaaribuu.

Blog-blog di internet melaporkan bukti akuan bersumpaj yang dibuat oleh penyiasat persendirian Balasubramaniam yang mengatakan Altantuya memberitahunya yang dia mempunyai hubungan peribadi dengan Najib dan kaitannya dengan rundingan pembelian senjata yang sama serta tentang bagaimana DSP Musa Safiri, pegawai polis pengiring Najib memainkan peranan dalam penangkapan dan pelenyapan Altantuya. Musa Safiri malah tidak dipanggil sebagai saksi dalam perbicaraan kes pembunuhan Altantuya.
Anwar pada bulan Julai tahun 2008 dan pada Februari tahun lalu turut memfailkan laporan polis berkenaan Gani Patail dan Musa Hassan atas peranan mereka dalam mereka-cipta bukti terhadap diri beliau dalam penyiasatan kes “mata lebam” pada tahun 1998. Laporan itu juga turut mendakwa mereka bersubahat memfailkan laporan polis palsu pada malam 20 September 1998 dalam hubungannya dengan penangkapan Anwar di rumah beliau di Bukit Damansara. Tidak ada satupun laporan-laporan ini menghasilkan pendakwaan biarpun seorang bekas hakim Mahkamah Persekutuan berpendapat Gani melakukan kesalahan jenayah dalam kes penyiasatan “mata lebam”.

Apa yang sedang diperjudikan sekarang ini adalah penggunaan kes aniaya dan palsu sebagai senjata politik untuk menghentikan kemajuan Anwar Ibrahim dan gerakan politik Pakatan Rakyat yang dipimpinnya. Suatu kemajuan gerakan yang mengancam kewujudan dan masa depan kerajaan Barisan Nasional dan para pemimpinnya.

Sodomy II : A nation Prepare To Go On Trial

It is a battle which Anwar will not fight alone. Millions will follow the courtroom battle blow by blow. It is not just Anwar who is on trial but also the judiciary, the law enforcement bodies and even the reputation of Prime Minister Najib Razak himself.

The month of February 2010 will bring the Lunar New Year with its colourful red ‘ang pows’ and the din of fire crackers to remind us that yet another tumultuous year has gone by. It will also witness the beginning of the long awaited court battle where Anwar will defend himself against a charge of consensual sodomy with his ex-aide.

It is a battle which Anwar will not fight alone. Millions will follow the courtroom battle blow by blow. It is not just Anwar who is on trial but also the judiciary, the law enforcement bodies and even the reputation of Prime Minister Najib Razak himself. As Anwar is also Malaysia's Opposition Leader, it is not just one man’s battle for honour and liberty but a battle in microcosm for the political future of the nation.

A conviction for Anwar may end his political career for good but only if Barisan Nasional wins the next general election. Should Pakatan Rakyat grab the seat of power there are ways to revive his political career starting with a judicial review to right any miscarriage of justice.

If charges are dismissed the Malaysian judiciary will receive a badly needed boost to its dented reputation and Najib may even score some brownie points for not interfering although the government will get a black eye. But if Anwar is convicted in the trial, which is already widely perceived as a parody of justice, a powerful shockwave will be generated which will dim the BN’s chances of fending off an assault by PR at the polls.

Make no mistake about this. It is not a matter of convincing the judge but convincing the public. To some dense Umno warlords, a speedy trial by a friendly judge and then off-to-prison-you-go is just the panacea that BN needs to demolish PR and guarantee its political hegemony. But this is more like a foolish man unable to see that he is sitting on a branch he is also sawing off.

Public perception

What is the public perception of this latest sodomy case? The events leading to Anwar being charged and the intense courtroom battles leading to the trial proper do not inspire much confidence that everything is aboveboard.

The accuser, Saiful did not behave like a rape victim who has been traumatized and humiliated by the alleged act. Public revelations that he had met Najib and a police officer in a Shah Alam hotel before making his police report and photographs of him with top Umno leaders did not bolster his case.

To top it off, Anwar is charged with consensual sodomy although his accuser had publicly declared that he was forced against his will and sworn in a mosque no less. Why is Anwar charged for consensual sodomy when the government has shown absolutely no interest in enforcing this archaic law against practicing gays?

The existence of two independent medical reports testifying that the alleged victim had never been penetrated should have scuttled the case completely but not this one.

The frenzied legal maneuverings by the prosecutors so far do not convince doubters either. Anwar was first charged in the Magistrate Court which is qualified to hear his case as it does not involve the death penalty. However the prosecutors fought tooth and nail to transfer the case to the High Court as if their whole case depends on it.

If the prosecution has strong evidence Anwar could be convicted in any court under any judge, then such intense effort to transfer his case without any creditable reason would not be necessary.

Furthermore the huge battle not to hand over witness testimonies to the defendant as required by the Criminal Procedure Code smacks of a prosecution which has no confidence in the strength of their own evidence and so must conduct a trial by ambush.

Beware of the truth

Lawyers know how hard it is to prove a case of genuine rape as such acts are usually committed unseen and unheard by witnesses but what are the chances of proving a case which never happened?

The effort to stage manage fabricated evidence in court would be tremendous. Witnesses have to be coached, their testimonies must tally and dovetail together, plausible explanations must be created for seemingly contradictory events and witnesses must remember what to say and what they have said. To make it even more challenging the whole contraption must stand up in court under the aggressive cross-examination of lawyers. But no matter how well planned, an unexpected revelation may throw a spanner into the works and bring the whole edifice tumbling down.

Truth has a way of coming out like water dribbling from a leaky container. Plug one hole and water finds another way out. Plug that and more holes appear.

What happened in Anwar’s sodomy trial 11 years ago should give any conspirators pause. The date of the offence was originally fixed as one night in May 1994. When his accuser Azizan testified that he had not been sodomized after 1993, the charge was changed to one night in May 1992. When the prosecution pointed out that Tivoli Villa, the place of the alleged offence had not been constructed yet in 1992, the charge was changed to one night between January and March 1993. When the defendant produced invoices to show that the apartment was under renovation at the material time the judge refused to accept it.

Do the witnesses have the mental toughness to maintain the charade under intense cross-examination? In the previous sodomy case, Azizan could not. He was asked three times and he replied three times that he had not been sodomized. It was only the judge who saved the prosecution’s case.

The 1999 sodomy trial was widely regarded as a sham. The prosecution in Sodomy II must do better, much better than this to convince a skeptical public.

Consensual or Not?

Anwar is charged under Section 377B of the penal code for voluntarily committing carnal intercourse against the order of nature. This is distinct from Section 377C where someone commits carnal intercourse against the order of nature on another person without the consent or against the will of the other person.

Section 377A defines carnal intercourse against the order of nature. A quirk in the description means that only the person who does the penetration is liable for prosecution. But if the act was consensual shouldn’t Saiful be charged for indecent behavior as well?

However there is a contradiction between the charge and the public stance of the star witness who has publicly insisted that the sodomy was against his will. When the trial begins the first order of business is to ask Saiful to declare whether the sodomy was consensual or not.

If Saiful still maintains that the act was against his will the charge must be amended to Section 377C or it is defective and must be thrown out. There is a whole world of difference between a consensual act and a forced act and we cannot have a man tried for consensual sodomy while the alleged partner insists that he was forced. This is against logic and natural justice.

Of course forced sodomy is more difficult to prove especially when the alleged perpetrator is a 62-year old man with a bad back and the alleged victim is a strapping youth bigger and stronger than him but that is the prosecution’s problem. The prosecution cannot give themselves an easier job by preferring a charge which does not reflect the reality on the ground.

If Saiful changes his tune to admit to consensual sodomy, the trial can proceed but a political time bomb may be triggered. This is because he had sworn in a mosque in front of the press and TV cameras that the act was against his will, with BN making political capital out of it at the Permatang Pauh by-election. This admission will be politically devastating for BN in the staunchly religious Malay heartlands but you reap what you sow.

DNA evidence

From what transpired during the Anwar’s battle to procure evidence from the prosecution it appears that the main evidence against Anwar will be DNA evidence.

In other countries DNA evidence is treated as supplementary or supporting evidence. It cannot stand by itself and is always used to support other evidence gathered. If DNA evidence shows that the defendant was at the crime scene but witnesses can testify that he was elsewhere, then the DNA evidence must be disregarded. This recognizes the fact that DNA tests are not infallible to mistakes and contamination.

Another important point is independent verification. Part of the original DNA sample must be made available to the defendant to enable him to engage his own specialists to verify the result or it becomes the word of the tester against his. However in Anwar’s case the prosecution has pointedly refused to hand over any DNA sample to him.

In the earlier sodomy case, chemist Lim Kong Boon testified that the stains on a mattress contained Anwar’s DNA mixed with several women. However in a brilliant cross-examination, his methodology and expertise were demolished and he was forced to admit that Anwar’s DNA could have been planted. The judge expunged the whole DNA evidence.

During Teoh Beng Hock’s inquest, government pathologists admitted that their samples were contaminated by an accident victim giving rise to doubts about their competence and methodology.

As there is a lag of 2 days between the alleged act and the police report made by Saiful and possibly longer to the medical examination, any notion that usable DNA evidence can be extracted from his rectum is stretching the imagination as such evidence would be destroyed on his first visit to the toilet for bowel movement.

With the public now leery of any DNA evidence, to use unsupported and unverified DNA evidence to try to convince the public of Anwar’s guilt is worse than useless. Such dubious evidence will only reinforce the suspicion that Anwar was framed.

One hopes that the prosecution has more in their bag to present a watertight case. Malaysians deserve better than the 1999 verdict in which Anwar was convicted on the basis of one man’s testimony whom the judge opined, “had no reason to lie.”

A man fights for his freedom, a nation fights for its future

If Anwar is to be convicted it must be based on strong evidence with no room for reasonable doubt. Justice must be done and be seen to be done. A repeat of the 1999 trial with a judgement which convinced nobody and a punishment grossly out of proportion to the alleged crime will be devastating for Malaysia.

Although things remain calm on the surface, civil society is traumatized by such naked display of power and crude perversion of justice. The trust between the government and the people is broken and the government’s respect and legitimacy bleeds away. Deep undercurrents of discontent are created which must eventually manifest in some ways.

Anwar’s fight to clear his name will be a defining moment for Malaysia. This is not about one man’s fight for justice but an indicator of the path the nation is taking.

As long as our democratic institutions are damaged, no Malaysian is safe from unjust prosecution and well-connected guilty ones can escape justice. It also means that there is no check and balance to prevent or remedy all manner of abuses and wrongdoings such as endemic corruption and plundering of resources.

The nation waits with bated breath as we stand at a crucial fork in the road to nationhood, wondering if we will take the path to a maturing democracy or slide down the slippery slope to a failed state like Zimbabwe and Myanmar.

PM NAJIB CRONIES & THEIR RELATED COMPANIES : StockTube

Everyone knows whenever there’s a change to the premiership not only political landscape changes but also the stock-market landscape. When Mahathir called it a day in 2003 almost immediately his cronies listed companies were affected. The same goes to Badawi although his departure doesn’t have the same impact due to his short-term in office. And now with Najib Razak as the new Prime Minister naturally his cronies or rather those who are closely linked to him are instantly on investors or punters’ radar. Malaysia politics and business model is rather unique because you will see both scratching each other for survival and prosperity. This is something that foreign investors found rather hard though amuse to accept or understand, not to mention frustration due to escalating in business operating costs.
Dow Jones went crazily above the psychological-level of 8,000-points before profit-taking trimmed the gains and closed at 7,978.08, thanks mostly to G20’s pledge of over $1 trillion to combat global economic crisis. However, the KLCI was marginally down following the release of the external trade data by the statistics department. Malaysia exports for February 2009 fell 15.9% year-on-year, while imports were 27.3% lower. Total trade in February was 21% lower at RM67.2bil, with trade surplus of RM11.97bil. The one-day bull in anticipation of Najib’s big day was over with KLCI didn’t move much despite the overnight jump in Dow Jones. Local KLCI is waiting for Najib’s speech to determine the next direction.
If Badawi’s circle of businessmen included Equine Capital Berhad’s Patrick Lim, ECM Libra Group's Kalimullah Hassan and Scomi Group's Kamaluddin Abdullah (his own son), Najib’s circle of businessmen is many times larger. So who are the people and companies closely linked to the new Prime Minister Najib Razak that could see their fortunes skyrocket?
1) Top on the list is non other than his youngest brother Nazir Razak, CEO of Bumiputra-Commerce Holdings Berhad (KLSE: COMMERZ, stock-code 1023) who studied philosophy at Cambridge University. Perhaps the most business-savvy within the family members Nazir was known for his infamous controversial acquisition of Southern Bank from owner Tan Teong Hean.
